Second Notice of Public Availability of Supporting Documents and Information

PUBLIC HEARING TO CONSIDER AMENDMENTS TO THE CALIFORNIA ZERO EMISSION VEHICLE PROGRAM REGULATIONS

This notice announces a second supplemental period in which the public may comment on additional modifications being proposed for amendments to the regulations establishing the California Zero Emission Vehicle (ZEV) program. No action by any member of the public is necessary unless the person wishes to comment on the additional modifications.

At a January 25, 2001 public hearing, the Air Resources Board (ARB or Board) considered adoption of amendments to section 1962, title 13, California Code of Regulations (CCR), and related regulations. The amendments, proposed by staff, would make major changes to the requirements imposed on manufacturers by the California Zero Emission Vehicle (ZEV) program. At the conclusion of the January hearing, the Board adopted Resolution 01-01, in which it approved the originally proposed amendments with a number of modifications. The Resolution directed the Executive Officer to incorporate the approved modifications into the proposed regulatory text, with such other conforming modifications as may be appropriate, and to make the modified text available for a supplemental 15-day comment period. On October 31, 2001, the proposed modifications were made available with a supplemental comment deadline of November 15, 2001.

The Notice announcing the supplemental 15-day comment period also stated that, in accordance with Government Code section 11347.1, the staff was adding to the rulemaking record the additional documents identified in Attachment III thereto. It indicated that comment on these additional materials would also be accepted until November 15, 2001. The most significant additional document being added to the rulemaking file is an October 31 Staff Response to a study entitled "Impacts of Alternative ZEV Sales Mandates on California Motor Vehicle Emissions" submitted by General Motors Corp. during the comment period just prior to the January hearing. Some of the emissions analysis in Sections 2.4 and 5 of the October 31 Staff Response was based on the EMFAC2001 ver. 2.07 emissions inventory model. Since October 31, staff has provided the model in electronic form and relevant source codes to members of the public upon request. However, staff has determined that it is appropriate to formally add that material to the rulemaking file, and to provide a supplemental period for comment on it.

Accordingly, this Notice announces that the electronic files listed below are being added to the rulemaking file for the 2001 amendments to the ZEV regulation. The materials have been posted on the ARB's Internet site for the regulatory documents in this rulemaking - http://www.arb.ca.gov/regact/zev2001/zev2001.htm. In order to be considered by the Executive Officer, comments must be directed to the ARB in one of the three forms described above and received by the ARB by 5:00 p.m. on November 30, 2001. The comment period on the October 31 Staff Response ends November 15, 2001. During the November 16-30 comment period on the newly added material listed above, the only comments regarding the October 31 Staff Response or the economic, environmental, or other impacts of the proposed amendments that will be considered by the Executive Officer will be comments on how the staff analysis or estimated impacts should appropriately be affected by EMFAC2001.
