Oceangoing Ship Onboard Incineration

The Office of Administrative Law (OAL) has approved the Airborne Toxic Control Measure Amendments Limiting Onboard Incineration on Cruise Ships and Oceangoing Ships (ATCM).  This ATCM, effective November 28, 2007, prohibits cruise ships and oceangoing ships from conducting onboard incineration within three nautical miles of the California coast.  These amendments implement the requirements of Senate Bill 771 ( SB 771).

Specifically, onboard incineration is prohibited between the California coast and the Three Nautical Mile Line as shown on the National Oceanic and Atmospheric Administration (NOAA) Nautical Charts.  To obtain copies of these charts please go to the NOAA website. Currently, the following charts make up the California coastline: 18600, 18620, 18640, 18680, 18700, 18720, 18740. 

Chart 18720, Point Dume to Purisma Point, and Chart 18740, San Diego to Santa Rosa Island, have been updated since adoption of the regulation.  The updated chart dates are as follows:  Chart 18720 (August 2008), Chart 18740 (March 2007).

On November 17, 2005, ARB adopted the Airborne Toxic Control for Measure for Cruise Ship Onboard Incineration (Cruise Ship ATCM). The Cruise Ship ATCM implements Assembly Bill 471 (AB 471) by clarifying the three nautical mile limit for incineration along the California Coast and establishing recordkeeping and reporting requirements. The Cruise Ship ATCM is expected to reduce public exposure to emissions of toxic air contaminants for residents and workers living or working in port communities and along the California Coast.

In October 2005, the Governor signed Senate Bill 771 (SB 771). SB 771 allows the ARB to adopt regulations which prohibit oceangoing ships from conducting onboard incineration within three miles of the California coast.  As mentioned above, the OAL has approved the ATCM amendments Limiting Onboard Incineration on Cruise Ships and Oceangoing Ships and is currently being enforced.
