The Office of Administrative Law (OAL) has approved the Commercial Harbor Craft Regulation (section 2299.5, title 13, and section 93118.5, title 17, California Code of Regulations). The regulation was filed with the Secretary of State on October 20, 2008, and will become effective on November 19, 2008. The Final Regulation Order is now available for download:

Staff have posted the Final Rulemaking Package for the Commercial Harbor Craft Regulation. The package was filed with the Office of Administrative Law (OAL) on September 5, 2008, and OAL has until October 17, 2008, to make a determination. The package includes the Final Statement of Reasons, which contains ARB's responses to all responsive comments received during the two public comment periods.

A Fact Sheet for Commercial and Charter Fishing Vessel Owners and Operators is now available.  The fact sheet discusses how the Commercial Harbor Craft Regulation affects these vessel types and explains what is required in order to comply with the new rule.

The Air Resources Board has posted the Notice of Public Availability of Modified Text (15-Day Notice) and Availability of Additional Documents for the Commercial Harbor Craft Proposed Regulation.   These documents and the associated "formal" regulatory materials can be accessed from our regulatory documents page. The deadline for public comment is July 3, 2008.

A Fact Sheet for the Commercial Harbor Craft Regulation is now available.  The Air Resources Board approved the regulation, with several modifications, in November 2007. The modified regulatory text will be released for a 15-day public comment period later this month.
If you own or operate an excursion vessel in California, we are requesting that you complete our Excursion Vessel Economics Survey. The survey was originally distributed in March 2008, but we are continuing to collect completed surveys.

You are invited to attend a Commercial Harbor Craft public workshop on May 7, 2008, from 9:30am to 11:30am in Sacramento (and via webcast). At the workshop, we will discuss staff's effort to evaluate the need to establish emission control requirements for crew and supply boats. Details are available in the workshop notice.

A public workshop will be held on April 15, 2008 from 10:00am to 12:00pm in Sacramento (and via webcast) for the AB 32 (California Global Warming Solutions Act) Goods Movement Sector. The purpose of the workshop is to provide an overview of Air Resources Board activities for this sector and to discuss concepts to achieve the maximum greenhouse gas emission reductions through strategies that are technically feasible and cost-effective.  Details are available in the workshop notice.

On March 14, 2008, the U.S. EPA released its final rulemaking for Category 1 and 2 commercial marine engines, which are primarily used in commercial harbor craft. The regulations apply to newly manufactured diesel engines with displacement less than 30 liters per cylinder installed on vessels flagged or registered in the United States. The regulations also include requirements for Category 1 and 2 remanufactured commercial marine diesel engines above 600 kilowatt (kW) or 800 horsepower (hp). Category 3 engines, which are typically used in ocean-going vessels, are not included in the rulemaking.

We are requesting that excursion vessel owners/operators complete a survey to help us further examine the economic impacts of the Commercial Harbor Craft regulation.  Please complete the survey by April 4, 2008.

At its public hearing on November 15, 2007, the Board approved the adoption of staff's proposed regulations (regulation) for reducing diesel emissions from commercial harbor craft. The regulation was approved with modifications that were suggested by staff at the Board hearing. Staff's suggested modifications can be found on the regulatory documents page (see "Hearing Action and Supplemental 15-Day Notices"). These modifications will be released for a public comment period of at least 15 days as part of the regulatory process. A list serve notice will be sent out at the beginning of the comment period.
