Leave Benefit Programs

As each of the individual collective bargaining unit agreements contain slightly different language in the areas of Annual Leave, Vacation Leave and Sick Leave, it is extremely important that supervisors and their employees refer to the appropriate bargaining unit agreement or contact the Labor Relations Staff for clarification prior to making any determinations regarding employee benefits in these areas.

The Annual Leave Program (ALP) is available to excluded employees and employees in Bargaining Units (BU) 2, 9, 10, 12, 13, 14, 16, 17, 18, 19, and 20 only. NOTE: BU 3, 4, 11, 15, and 21 DID NOT PARTICIPATE in the ALP and are, therefore, ineligible for this program.

BU 1 recently negotiated a Side Letter with the following provisions:

Any employee who is currently enrolled in the ALP and transfers into BU 1 after May 1, 2000 shall have their enrollment in the ALP terminated, effective the first of the month following their transfer into BU 1. These employees shall be enrolled in the vacation and sick leave programs. Any employee who is or was enrolled in the ALP and moved into BU 1 prior to May 1, 2000 may elect either of the following: Remain in the ALP until July 2, 2001, such election to be retroactive to the date of their enrollment in the ALP was terminated; or, Convert to the traditional Vacation Leave/Sick Leave Program, such election will be retroactive to December 1, 1999 or the month following transfer into BU 1, whichever is later. An employee who fails to return their election form to the Personnel Office by 5:00 p.m. on May 20, 2000, will be automatically placed in the traditional Vacation Leave/Sick Leave program.

Eligible employees have the option to change their leave program if they choose to do so. They may choose the ALP or the Vacation Leave/Sick Leave Program. An accrual schedule for both the ALP and Vacation Leave/Sick Leave Program can be found below. Employees who elect to change to the ALP from the Vacation Leave/Sick Leave Program no longer have to wait 90 days for enhanced Nonindustrial Disability Insurance (NDI).

GENERAL PROVISIONS -- ANNUAL LEAVE PROGRAM


Effective October 1, 1999, eligible employees may make an initial voluntary election to change from the Vacation Leave/Sick Leave Program to the ALP. This election is no longer irrevocable. Employees who elect the ALP may change to the Vacation Leave/Sick Leave Program after they have been in the ALP for a minimum of 24 months.

The ALP provisions are as follows:

Enhanced NDI of 50 percent of actual salary for illness or injury related absences of more than seven calendar days' duration for a 26-week period per event. Employees may supplement enhanced NDI with leave credits in order to receive either 75 percent or 100 percent salary. No limit on the number of days that earned credits may be used for family illness. Accrued annual leave may be used for any type of approved absence. Employees who have been in the Vacation Leave/Sick Leave Program keep and may use accumulated sick leave in accordance with the Sick Leave provisions of their bargaining unit agreement. Vacation leave converts to annual leave on an hour-for-hour basis. All accrued annual leave that is unused at the time of separation from State service is compensable. A 640-hour annual cap on accumulated annual leave credits.

GENERAL PROVISIONS -- VACATION/SICK LEAVE PROGRAM


Effective October 1, 1999, eligible employees who have been in the ALP may make a voluntary election to change to the Vacation Leave/Sick Leave Program. This election is not irrevocable but may not be changed until the eligible employee has been in the Vacation Leave/Sick Leave Program at least 24 months from the date of election.

The Vacation Leave/Sick Leave Program provisions include:

A separate sick leave and vacation leave accrual rate and bank. Unlimited sick leave accrual. An NDI payment of up to $135 a week for 26 weeks per illness for employees when leave credits are exhausted. At time of separation, accumulated vacation is compensable; accumulated sick leave is not compensable but is added to retirement qualifying service on a day-for-day basis. The annual cap on accumulated annual leave credits varies by bargaining unit - check your bargaining unit agreement for specifics..

For more detailed information on the ALP, pick up a copy of the Department of Personnel Administration's publication entitled, "The Annual Leave Program" in the Personnel Office.

If you would like to change from your current leave program, please contact your assigned Personnel Services Specialist to complete the necessary form. All movements from one leave program to another will be effective the first day of the pay period following receipt of the election form in the Personnel Office.

Employees are not entitled to vacation leave credit for the first six months of service. On the first day of the monthly pay period following completion of six qualifying monthly pay periods of continuous service, full-time employees covered under the Vacation leave program shall receive a one-time vacation bonus of 42 hours of vacation credit. Thereafter, for each additional qualifying monthly pay period, the employee shall be allowed credit for vacation with pay on the first day of the following month as follows:
