The Fleet Rule for Transit Angencies was first adopted in 2000 focusing on reductions in diesel particulate matter and oxides of nitrogen emissions from urban buses and transit fleet vehicles. Transit agencies were required to select either the diesel path or the alternative-fuel path. Large transit agencies with 200 or more buses were required to demonstrate zero-emission buses with an earlier schedule for diesel and a later schedule for the alternative fuel path.

In 2009 the Board, through Resolution 09-49, directed staff to suspend implementation of the purchase requirement, to research and develop commercial-readiness metrics to be used as criteria to initiate zero-emission bus purchase requirement, and to conduct a technology assessment on the readiness of zero-emission bus technologies. Significant technology advancements have occured since 2009. The recent reports of technology and fuels assessments indicate both battery and fuel-cell electric buses are commercially available for transit applications.
