harborcraft -- Compliance Reporting Deadlines for In-Use Commercial Harbor Craft Engines

The Air Resources Board’s (ARB or Board) Commercial Harbor Craft
Regulation (CHC Regulation) requires owners and operators with
engines subject to the in-use engine emissions limits to report
what they have done to bring these engines into compliance, per
California Code of Regulations (CCR), title 17, section 93118.5,
subsection (e)(6). 

If you own or operate a vessel meeting the criteria listed in
Table 1 below, by December 31, 2014, you must:

1. Upgrade your engine(s) to meet the current United States
Environmental Protection Agency (U.S. EPA) Tier 3 marine or
off-road engine emissions standards .  (U.S. EPA Tier 3 marine
engine emissions standards are defined in CHC Regulation section
93118.5, subsection (d)(82), Tables 3, 4, and 5); and 

2. Submit a Demonstration of Compliance report to ARB, describing
in detail the actions taken to upgrade your engine(s).  To file
this report, please update your initial report by completing
report columns 51 – 54 (Excel columns AI through AM) on the
“Engine Information” worksheet of the CHC reporting form.   The
CHC reporting form can be downloaded at the following website:

Table 1(items a-e):  In-Use CHC Auxiliary and Propulsion Engines
that must be Upgraded to Current Engine Emission Standards by
December 31, 2014
(Per CCR, Title 17, section 93118.5, subsection (e)(6)(D) Tables
7 through 10)

a. Vessel Category: Ferries,Excursion Vessels,and Tug, Tow, and
Push Boats

   Annual Operational Hours: >=300 and <=1500 hours

b. Vessel Catergory: Ferries	
   Home Port: Outside South Coast AQMD	
   Engine Model Year: 1996-1999	
   Annual Operational Hours: >=300 hours

c. Vessel Catergory: Ferries, Excursion Vessels, and Tug, Tow,
and Push Boats	
   Home Port: Within South Coast AQMD	
   Engine Model Year: 2001	
   Annual Operational Hours: >=300 hours

d. Vessel Catergory: Crew and Supply Vessels
   Home Port: Statewide	
   Engine Model Year: 1986-1995
   Annual Operational Hours: >=300 and <=1500 hours

e. Vessel Catergory: Barge and Dredge Vessels
   Home Port: Statewide	
   Engine Model Year: 1986-1990
   Annual Operational Hours: >=80 hours
(Note: ARB amended the CHC regulation in 2010, adding in-use
engine emission limits for engines on crew and supply vessels,
barges, and dredges.  ARB is currently seeking U.S. EPA
authorization for these added provisions and will not enforce the
associated emission limits until authorization is received.)

The CHC regulation was adopted in November 2007 and became
effective in January 2009.  Commercial harbor craft includes crew
and supply vessels, commercial fishing vessels, ferries,
excursion vessels, pilot boats, tugboats, towboats, barges,
dredges, and workboats.  The CHC regulation has reporting,
recordkeeping, and monitoring requirements.  In addition, CHC
regulation requires existing Tier 1 and earlier auxiliary and
propulsion engines on in-use ferries, excursion vessels,
tugboats, towboats, crew and supply, barges, and dredges to meet
U.S. EPA Tier 2 or Tier 3 marine engine standards in effect at
the time compliance is required.  This regulation is part of
ARB’s ongoing effort to reduce diesel particulate matter in
communities located near ports.
