ARB has received United States Environmental Protection Agency
(U.S. EPA) authorization to enforce the Cargo Handling Equipment
Regulation, including new and in-use engine emission limits.

Proposed Amendments

On December 8, 2005, the Air Resources Board (ARB) adopted the
Cargo Handling Equipment Regulation (CHE Regulation), which has
emission limits for both new and in-use diesel engines in mobile
cargo handling equipment, as well as requirements for reporting,
recordkeeping, and fuel use.  ARB was required to request
authorization from the U.S. EPA to enforce the new and in-use
requirements.  On November 28, 2011, the U.S. EPA authorized ARB
to enforce these provisions of the CHE regulation.  ARB will
begin enforcing these provisions on August 1, 2012.  Advisory

Cargo handling equipment is used to transfer goods or perform
maintenance and repair activities and includes equipment such as
yard trucks (hostlers), rubber-tired gantry cranes, top handlers,
side handlers, forklifts, and loaders, just to name a few.  The
Regulation for Mobile Cargo Handling Equipment at Ports and
Intermodal Rail Yards was adopted in December 2005 to reduce
diesel particulate matter in communities located near ports and
intermodal rail yards.  Additional information on the regulation
