On Wednesday, December 14, 2011, the Office of Administrative Law approved amendments to the regulations for In-Use Off-Road Diesel-Fueled Fleets (Off-Road regulation), and Large Spark-Ignition Engine Fleet Requirements (LSI Fleet regulation). The amendments became effective on that same day, December 14, 2011. Background The Off-Road regulation was approved in 2007, and is intended to significantly reduce emissions of diesel particulate matter (PM) and oxides of nitrogen (NOx) from the over 150,000 in-use off-road diesel vehicles that operate in California by requiring their owners to modernize their fleets and install exhaust retrofits. The LSI fleet regulation was approved in 2006, and is intended to reduce hydrocarbon and oxides of nitrogen (HC+NOx) emissions from the nearly 90,000 LSI vehicles operating in California by accelerating the introduction of new clean vehicles and the retrofit or retirement of uncontrolled in-use vehicles. On December 17, 2010, ARB staff recommended amendments to both regulations that were subsequently adopted by the Board and approved by the Office of Administrative Law on December 14, 2011. The amended Off-Road regulation delays the initial compliance date for all fleets by four years, provides a path to compliance without any required retrofits, simplifies the regulation, and lowers the cost of the regulation significantly while still maintaining progress toward clean air. The amendments also include additional minor modifications to clarify or simplify regulatory provisions. The amended LSI fleet regulation adds and modifies several definitions, reinstitutes the limited hours of use provisions, broadens compliance extension flexibility, and makes other minor clarifications. Although the amended Off-Road regulation is now in effect, the Air Resources Board (ARB) will not be enforcing the performance requirements of this regulation until authorization is received from the United States Environmental Protection Agency (U.S. EPA). However, please note that the reporting, labeling, idling, and disclosure requirements of the Off-Road regulation are in effect and currently being enforced throughout California.
