This note is to inform fleets that ARB will not be enforcing the April 1, 2011, off-road regulation large fleet reporting and compliance certification deadline. The first large fleet annual reporting date (and due date for a signed statement affirming compliance) will instead be March 1, 2012. Section 2449(g)(2) of the off-road regulation that is currently in effect includes a requirement for large fleets to update their DOORS data and submit a compliance certification signed by a responsible official (now called a Responsible Official Affirmation of Reporting) by April 1, 2011, but the December 2010 amendments modified this requirement. Prior to the December 2010 amendments, fleets were required to submit the compliance certification by April 1 of each year. The amendments voted on by the board in December would require fleets to submit a Responsible Official Affirmation of Reporting (formerly compliance certification) by March 1 of each year. To avoid confusion, neither deadline is being enforced for calendar year 2011. However, we encourage you to double check that your DOORS data is accurate. Additionally, we thank those fleets who have already submitted their annual reporting and compliance certification for this year. We also remind fleets that the requirements to report added vehicles within 30 days to ARB and the requirement to label vehicles with red and white Equipment Identification Numbers (EINs) remain in effect and are being enforced. Your diligence in submitting this information on time is greatly appreciated. Background At the December 17, 2010 Board Hearing the Air Resources Board voted on major amendments to the off-road regulation. The amendments include a four year delay from the original timeline for all fleets, making the first compliance deadline January 1, 2014, for large fleets (over 5,000 hp), January 1, 2017, for medium fleets (2,501-5,000 hp), and January 1, 2019, for small fleets (2,500 hp or less). They also include a dramatic reduction and simplification in the annual requirements for fleets, and fleet average structure, making exhaust retrofits no longer mandatory, and raising the low use threshold to 200 hours per year. The off-road regulation is intended to reduce toxic and smog-forming emissions from off-road vehicles. Reducing such emissions is necessary to meet federally imposed clean air standards and to reduce the adverse health effects from air pollution throughout the state.
