Remember to update your ARBER Registration compliance information
after you comply with the in-use performance standards. 

The California Air Resources Board’s (ARB) Transport
Refrigeration Unit (TRU) Airborne Toxic Control Measure (ATCM)
requires California-based TRU owners to register their TRUs with
ARB by July 31, 2009.  Owners may register online, using ARB’s
Equipment Registration (ARBER) system.  Further information about
the TRU ATCM and the requirements discussed herein may be found
at the TRU Website at:  http://www.arb.ca.gov/diesel/tru.htm. 
Online registrations may be completed at the ARBER website at: 
http://www.arb.ca.gov/arber/arber.htm.

If you have registered your TRU in ARBER and subsequently bring
that TRU into compliance with the in-use performance standards,
you must update the compliance information in ARBER.  Failure to
update this information within 30 days of compliance is a
violation that is subject to penalties up to $300 per violation.

There are three cases where registration information updates are
necessary as a result of complying with the TRU ATCM in-use
performance standards:

1.	Model year 2001 or older engines:  If the unit was
noncompliant with the in-use performance standards at the time of
registration, ARBER did not issue an ARB Identification Number
(IDN).  Applicants were required to carry the ARBER certification
page with the TRU to show the ARB inspector that partial
compliance with the registration requirement had been achieved. 
Model year 2001 and older units must comply with the in-use
performance standards by December 31, 2009.  ARB urges you to
comply now so that you don’t miss the compliance deadline.  There
will be no further delays in this deadline.  After a TRU is
brought into compliance, the owner has 30 days to complete the
registration process by updating the compliance information in
ARBER so that an IDN is issued on the new certification page. 
Until the owner provides information about how the TRU was
brought into compliance, the TRU is not fully compliant with the
registration requirement.  The owner then has 30 days to affix
the IDN to both sides of the TRU housing (see TRU Advisory
08-10-R1 at:  http://www.arb.ca.gov/diesel/tru/advisories.htm). 
The new certification page must be carried with the TRU until the
owner affixes the IDN.  Thirty days after the IDN is issued, ARB
inspectors will not accept ARBER certification pages instead of
the IDN being affixed to the TRU housing.

2.	Model year 2002 engines:  These engines must also meet the
in-use performance standards by December 31, 2009.  There will be
no delays in this deadline.  ARB urges you to comply now so that
you don’t miss the compliance deadline.  These model year TRUs
were issued IDNs when they submitted a complete registration
application, because they were in compliance until the applicable
in-use performance standard deadline (December 31, 2009).  After
compliance with the in-use standard is achieved, the owner has 30
days to update ARBER by providing information about how the TRU
was brought into compliance.

3.	Model year 2003 and newer TRU engines:  These engines have
the same compliance requirements as described in case #2, above,
but compliance deadlines are December 31st of the seventh year
after the model year.

In addition, the operator of a California terminal where TRUs
are garaged, operated, maintained, or dispatched from must submit
an Operator Report to ARBER by July 31, 2009.  After ARBER issues
IDNs, the operator has 30 days to update the Operator Report by
adding the new IDNs that are assigned to a terminal.  Operator
Report updates may be completed online by logging into ARBER. 
Failure to update the Operator Report within 30 days of being
issued and IDN may result in citations and penalties up to $300
per violation.

ARB will begin enforcement of the In-Use Performance Standards
after December 31, 2009.  TRUs that are found to be noncompliant
with the in-use standards will be subject to penalties up to $500
per violation.  There will be no grace periods for late
ordering.
