ordiesel -- Changes to Off-road Diesel Vehicle Regulation Approved

On July 23, 2009, the Air Resources Board (ARB) approved
amendments to the in-use off-road diesel vehicle regulation (the
regulation).   The amendments include:
•	New credits for fleets that have experienced drops in activity
of their vehicles and/or that have reduced their fleet size; and
•	Allowing all large fleets to delay a portion of their
compliance obligations currently required for 2011 and 2012 until
2013.  
The amendments also include new incentives to spur early actions
by fleets including the following: 
•	Allow fleets to claim an exemption for up to 15 percent of
their total horsepower (hp) from future turnover if they install
a retrofit prior to March 1, 2011;
•	Allow fleets to claim double credit for NOx retrofits
installed by March 1, 2011;
•	Allow medium and small fleets to claim double credit for PM
retrofits installed by March 1, 2012; and 
•	Allow fleets to accumulate NOx carryover turnover credit for
early repowers installed, regardless of the total amount of fleet
hp that is repowered.

Staff is working to update our compliance planning tools, the
fleet average calculator and DOORS compliance planning feature,
to reflect the amendments and will release revised versions as
soon as possible.  

The Board made one change to staff’s proposal for the regulation
– directing staff to change the word “impossible” to “infeasible”
in the following sentence regarding the exemption for unsafe
retrofits so that it reads as follows,  “The Executive Officer
shall accept the official findings of the responsible federal or
state agency that compliance with the requirements of this
regulation would make compliance with the federal and state
safety or health requirements infeasible.”  The Board also
directed staff to report back in December, 2009, after the
initial reporting for the regulation is complete and in July,
2010, after data has been compiled regarding the effect on
emissions from the legislatively directed amendments and the
economic downturn.
