The California Air Resources Board (CARB or Board) invites you to
participate in two public workshops to discuss upcoming updates
to CARB’s enforcement policies.  Our current penalty policy was
adopted in 2011.  CARB is updating its penalty policy partly to
respond to AB 1685 (2016) which, among other things, increases
the maximum penalties for mobile source violations and clarifies
how those penalties can be applied.  In addition to updating the
current penalty policy to address AB1685, we are taking this
opportunity to develop a more comprehensive enforcement policy. 

The same information will be presented at each workshop.  The
workshops will be held at the following locations and times:

Background

The current penalty policy was developed in 2011 to comply with
SB 1402 (2010) which required that CARB articulate the basis for
determining penalties for violations discovered through
enforcement actions.  CARB is updating its current penalty policy
partly to respond to AB 1685 (2016), which better aligns
California’s maximum mobile source penalties with federal
penalties.  AB 1685 increases the maximum penalty for mobile
source violations, and clarifies CARB’s ability to enforce
multiple violations for each applicable mobile source.  CARB is
soliciting public input on potential impacts of AB 1685 and on
developing a more comprehensive enforcement policy overall.
