Portable Equipment Registration Program - Regulation Activities

The Statewide Portable Equipment Registration Program (PERP) establishes a uniform program to regulate portable engines and portable engine-driven equipment units. Once registered in PERP, engines and equipment units may operate throughout the State of California without the need to obtain individual permits from local air districts. Districts are pre-empted from permitting, registering, or regulating portable engines and portable equipment units registered with the Air Resources Board (ARB/Board); however, local air districts are responsible for enforcement of PERP.

ARB is authorized by California Health and Safety Code sections 41750 through 41755 to adopt a regulation to establish a uniform statewide program for the registration and regulation of portable engines and portable engine-driven equipment units. In developing these regulations, ARB is required to evaluate emissions, identify emission control technologies, hold public hearings, establish emission limits and control requirements, and develop a fee schedule to cover the costs to adopt and administer the program, including the cost of the air pollution control districts' enforcement.

The Board approved amendments to the PERP Regulation at a public meeting on February 26, 2004. At that meeting, the California Air Pollution Control Officers Association (CAPCOA) raised a number of concerns and the Board directed staff to continue to work with CAPCOA and affected industry to resolve these issues. CAPCOA, in consultation with a number of affected industries, has developed suggested amendments to the PERP Regulation. The suggested amendments include recommendations for district inspection fees, notification requirements, and recordkeeping and reporting requirements.

ARB staff will hold a public consultation meeting on Thursday, December 1, 2005 from 10:00 a.m. to 3:00 p.m. at the Cal/EPA Headquarters Building in Sacramento. Staff will provide background information about the current PERP Regulation, discuss the suggested amendments from CAPCOA, and solicit your comments.
