Public Hearing to Consider Adoption of Proposed Chapter 3, Legal
Authority as a Revision to the State Implementation Plan

                              RECOMMENDATION

Adopt Resolution 78-58

                                  SUMMARY

This is a public hearing for the Board to consider adopting
Chapter 3, Legal Authority as a revision to the SIP.  This
chapter has been prepared to meet administrative requirements of
the Clean Air Act and related EPA regulations.

Chapter 3 sets forth the legal authority of state and local
agencies to implement the SIP and describes various procedures
related to the SIP.  This chapter complies with the requirements
of 40 CFR Section 51.11 (Title 40 of the Code of Federal
Regulations).

As the proposed action is the adoption of one administrative
chapter of the SIP and no regulatory action is proposed in this
chapter, there is no potential environmental impact anticipated
as a result of this action.

This chapter was distributed previously to Board members, all air
pollution control districts, nonattainment lead agencies, and
interested public.  Copies are also available at this hearing.

Status Report on Nonattainment Plan/State Implementation Plan
Revision Status and Issues.

                              RECOMMENDATION

This is an informational report, thus no action is required.

                                  SUMMARY

The Clean Air Act requires all areas not attaining the National
Ambient Air Quality Standards to prepare plans (nonattainment
plans) to attain the standards by December 31, 1982 (for oxidant
and carbon monoxide extensions to 1987 are possible).

These nonattainment plans, being prepared by local and regional
agencies, are to be submitted to the Air Resources Board for
consideration as revisions to the State Implementation Plan.  The
Board has authority to amend the plans prior to adoption if it
finds, at a public hearing for which 30 days public notice has
been given, that the plans do not comply with Clean Air Act or
related EPA requirements.

The staff has been reviewing and commenting to local agencies on
draft plans.  Local adoption of many plans has occurred; however,
it is anticipated that a number of locally adopted plans will not
be received by the staff in time for presentation to the Board
prior to January 1979.  Air Resources Board hearings on local
plans are expected to begin in early 1979.

This report presents staff interpretation of the requirements for
an adequate plan and the statewide issues associated with some of
these requirements as well as a discussion of additional
statewide issues that have surfaced during preparation and review
of draft plans.  In addition, the status and schedule for local
adoption of each plan and the staff proposed format for
integrating the local plans into the SIP are included.
