ITEM NO.: 75-9-2

Public Hearing to Consider the Definition of "Light-Duty
Vehicles" in Section 2175 of Title 13, California Administrative
Code.

RECOMMENDATION

Adopt Resolution 75-28.

SUMMARY

The California Highway Patrol has encountered an emissions
enforcement problem at its roadside inspection lanes due to an
out-dated light-duty vehicle definition in Section 2175 of Title
13. Light-duty vehicle definitions have been used in new vehicle
approval test procedures since 1966. Definitions for passenger
cars and light-duty trucks, in use since 1972, have been
incorporated into the proposed amendment to Section 2175 of Title
13, California Administrative Code.

Public Hearing to Consider Inspection Specification Regulations
in Title 13--New Vehicles. (Continued).

RECOMMENDATION

Adopt Resolution 75-13.

SUMMARY

The Air Resources Board proposes to delete Section 2150 of
Title 13 of the California Administrative Code. This section
sets forth inspection surveillance procedures for new motor
vehicles at dealerships. In its place a new Section 2151 is
proposed to make more specific regulations relating to new
vehicles and to clarify responsibility for ensuring compliance.

This item was discussed at the Board's March 17, 1975 meeting.
The staff has reviewed manufacturer's comments and additional
changes to the resolution which were submitted at that meeting.

Public Hearing to Consider Inspection Specification Regulations
in Title 13--Used Vehicles.

RECOMMENDATION

Adopt Resolution 75-22.

SUMMARY

The Air Resources Board proposes to add Section 2152 to Chapter
3, Title 13 of the California Administrative Code. This section
sets forth inspection and surveillance procedures for used motor
vehicles at dealerships. These regulations are proposed to make
specific regulations relating to used vehicles and to clarify
responsibility for ensuring compliance.

Since the public hearing notice was published, the staff has made
some amendments to the original proposal. The checks required to
be made by dealers are clarified and the idle mixture adjustment
procedures are changed to ensure that manufacturers' adjustment
procedures and specifications are used. Some revisions are
proposed to conform with the regulations of the Bureau of
Automotive Repair.

Public Hearing for Adoption of Proposed Changes to Vehicular
Enforcement Regulations Including Recall Procedures.

RECOMMENDATION

Adopt Resolution 75-21.

SUMMARY

At its February 19, 1975 Board meeting the Board adopted
emergency amendments to it regulations in Title 13, relating to
enforcement of its standards and test procedures. These
amendments, with minor changes, came before the board for
confirmation as permanent regulations at its April 16 meeting,
and were continued to this date. These regulations bring the
Board's enforcement procedures into conformity with the recent
legislative amendment of Health and Safety Code Section 39154 and
specify the conditions and procedures for recall actions. The
proposed action would also clarify the Executive Officer's
authority in the event of assembly line inspection testing
violations. The amendments proposed at the April meeting have
been altered in only one regard; the addition of language to
Section 2109(a) to provide for a hearing in the event of
corrective action not involving a recall.

Estimate of the Contribution of Motorcycles to California Air
Pollution.

RECOMMENDATION

None. Informational item.

SUMMARY

The staff has evaluated the contribution of motorcycles to
California's air pollution problems as directed by the Board at
the February 19, 1975 meeting.

A report concerning a proposed motorcycle emission control
program will be presented at the Board meeting.

Eighth Quarterly Report on the Efforts and Progress of
Manufacturers in Meeting the Federal Statutory Vehicle Emissions
Standards.

RECOMMENDATION

None. Informational Item.

SUMMARY

The Air Resources Board staff has reviewed the vehicle
manufacturers' quarterly efforts and progress reports required
pursuant to Sections 39158 and 39159 of the California Health and
Safety Code. The reports provide updated information on the
manufacturers' efforts and progress in achieving the exhaust
emission goals promulgated by the Federal Clean Air Act and
referred to as the Federal statutory standards. A summary of the
reports is required to be filed with the Legislature and the
Governor.
