ITEM NO.: 91-2-2 Public Meeting to consider the Proposed Update to the List of Substances for the Toxic Air Contaminant Program. RECOMMENDATION The staff recommends that the Board approve the proposed revisions to the list of substances as presented in the Proposed Update to the List of substances for the Toxic Air Contaminant Program, February 1991. DISCUSSION This report presents the latest update to the list of substances used in the Board's Toxic Air Contaminant Program. This list contains: substances identified as Toxic Air Contaminants by the Board; substances which are under review or nominated for review; and substances being evaluated for review as candidate Toxic Air Contaminants. The list is prepared and used by the staff in setting priorities for evaluating substances as Toxic Air Contaminants. The first list was approved by the Board in January 1984 and has been updated each year thereafter. The proposed list, "Toxic Air Contaminant Identification List, February 1991," reflects changes to the February 1990 list. The proposed revisions are partly based on the addition of 189 Hazardous Air Pollutants to section 112 of the Federal Clean Air Act. Because Health and Safety Code section 39655 requires that the Board identify Federal Hazardous Air Pollutants as Toxic Air Contaminants, Federal Hazardous Air Pollutants not included on the February 1990 list have been added to the February 1991 list. In addition to adding substances to the list, category definitions for the list have been revised to clarify the status of substances in the program as well as the factors that are considered prior to reviewing a substance for identification as a Toxic Air Contaminant. Hazardous Air Pollutants added to the list were placed in one of two subcategories based on available California emissions data. In addition, substances which are not Hazardous Air Pollutants were added to the list if California emissions data were available. A determination of whether a substance is emitted in California was made based on review of air toxics emission databases. A request for information and comment on the proposed Toxic Air Contaminant Identification List of substances was mailed to the public on December 26, 1990. Staff also requested and received comments on the proposed revisions to the list from the Department of Health Services. In addition, the Scientific Review Panel on Toxic Air Contaminants was notified of the proposed changes to the list. SUMMARY AND IMPACTS OF PROPOSED ACTION The following changes are proposed to the February 1990 Toxic Air Contaminant Identification List: Move inorganic arsenic, trichloroethylene, vinyl chloride, and chloroform from Subcategory IIA to Category I. The purpose of this change is to reflect the fact that these substances have been identified by the Board as Toxic Air Contaminants; Move styrene from Subcategory IIB to Subcategory IIA. The purpose of this change is to reflect the fact that styrene is currently under review for identification as a Toxic Air Contaminant. Styrene was selected for review because is considered a possible human carcinogen by IARC, significant amounts of styrene are emitted to the atmosphere in California, and styrene is detected in the ambient air throughout the state; Move inorganic lead from Subcategory IIB to Subcategory IIA. The purpose of this change is to reflect the fact that inorganic lead is currently under review for identification as a Toxic Air Contaminant. Inorganic lead was selected for review because it is considered a possible human carcinogen by IARC, significant amounts of styrene are emitted to the atmosphere in California, and styrene is detected in the ambient air throughout the state; Move inorganic lead from Subcategory IIB to Subcategory IIA. The purpose of this change is to reflect the fact that inorganic lead is currently under review for identification as a Toxic Air Contaminant. Inorganic lead was selected for review because lead and inorganic lead compounds are considered possible human carcinogens by IARC, significant amounts of lead and lead compounds are emitted to the atmosphere in California, and lead is detected in the ambient air throughout the state; Move coke-oven emissions from Subcategory IIB to Subcategory IIIB. The purpose of this change is to reflect the fact that there are no known emission sources of coke-oven emissions operating in California; Revise the definition of Category II to state "Substances currently under review or nominated for review for identification as Toxic Air Contaminants;" Revise Subcategory IIA to state "Substances already in the review process;" Revise Subcategory IIB to state "Substances nominated for review;" Revise Category III to state "Substances which are being evaluated for entry into Category II (IIA or IIB). Factors considered in this evaluation include carcinogenic and non carcinogenic health effects, emissions and exposure in California;" Add Subcategory IIIA which states "Substances known to be emitted in California (includes Hazardous Air pollutants identified in the Federal Clean Air Act known to be emitted in California);" Add Subcategory IIIB which states "Substances identified as Hazardous Air Pollutants in the Federal Clean Air Act for which California emissions information is not currently available;" and Add 170 substances to the February 1990 Toxic Air Contaminant Identification List: 102 to Subcategory IIIA and 68 to Subcategory IIIB. With the addition of the new substances, there are 232 substances on the proposed February 1991 list. ITEM NO.: 91-2-3 Annual Report on the Status of the Air Toxic Control Measure Development Program. RECOMMENDATION Information only. DISCUSSION The staff will give an oral presentation on the status of the development and implementation of toxic control measures, highlighting the ARB's accomplishments since the AB 1807 program began. A recap of actions taken by the Board over the past six years to implement the toxics program will be discussed, along with plans for future control activities. The staff annually updates the Board on the toxics program.
