Public Hearing to Consider the Approval of Attainment Plans for
Districts Within the Southeast Desert Air Basin.
RECOMMENDATION
That the Board fully approve the Kern plan, and conditionally
approve the plans for San Bernardino and Imperial; and that the
Board require the districts to submit supplementary data
commitments to assure full compliance with the California Clean
Air Act in the manner and time proposed by staff.
DISCUSSION
The three individual plans submitted by Kern, San Bernardino, and
Imperial must satisfy California Clean Air Act requirements.
Staff is recommending that the Board find as follows:
The Kern plan is substantially complete, includes all feasible
measures, and an expeditious rule adoption schedule. All other
requirements are satisfied, except that a minor change to the
plan inventory needs to be addressed by the next revision and a
commitment to adopt BARCT levels for selected stationary source
controls needs to be made.
The San Bernardino plan contains all feasible measures and
addresses public education and contingency measures. It also
contains the two reasonably available transportation control
measures which are most applicable to the San Bernardino area.
The District must address the applicability of the remaining
available transportation control measures and emission accounting
requirements to be fully approvable. In addition, the San
Bernardino's proposed schedule for rulemaking is not sufficiently
expeditious within the meaning of the California Clean Air Act
and given the particular circumstances facing the District. The
plan does not satisfy the "no net increase" requirement for new
and modified stationary sources which have a potential to emit 25
tons per year or more of any nonattainment pollutant or its
precursors. Finally, the District Board only partially satisfied
the cost-effectiveness requirements.
The Imperial plan is substantially complete, includes all
feasible measures and proposes expeditious rule adoption.
However, the Imperial plan does not satisfy the "no net increase"
requirement for new and modified stationary sources which have a
potential to emit 25 tons per year or more of any nonattainment
pollutant or its precursors. Also, the District needs to further
address the emission inventory requirement and the accounting of
emission reductions.
SUMMARY AND IMPACTS
Partial approval of the plans will allow each of the districts to
begin implementing satisfactory plan elements while other plan
elements are more completely addressed or clarified. For the
Kern County District, emission reductions, on the order of 5.6
tons per day of ROG and 6.4 tons per day of NOx, can be expected
from full implementation of plan measures. For Imperial County,
emission reductions of at least 2.6 tons per day of ROG and 4.6
tons per day of NOx can be expected by 1994 from full
implementation of the plan measures. These estimates are
expected to increase upon the Imperial District's modifications
to their plan as directed by the Board upon staff recommendation.
For the San Bernardino District, staff is also recommending that
the Board direct the District to accelerate its rulemaking
calendar, which will result in significant progress of reductions
beyond what is described by the plan by 1994. However, the exact
quantity of resulting emission reductions cannot be determined
until the District responds to the Board directions.
