Executive Session - Personnel and Litigation b. Research Proposals ITEM NO. 77-4-2 Status Report on the Mandatory Vehicle Inspection Program (MVIP). RECOMMENDATION None, information only. SUMMARY The Mandatory Vehicle Inspection Program (MVIP) is now scheduled to begin January 1, 1979 in the South Coast Air Basin. For a minimum of two years inspections will be required for vehicles undergoing change of ownership and for vehicles stopped at roadside inspection facilities to be operated by the Highway Patrol. Approximately 30-40% of the vehicle population will be tested annually under this program. A Request for Proposal to build and operate the approximately twenty permanent inspection facilities needed for the change of ownership phase of the MVIP was released on January 19, 1977. Bids are due by March 1, 1977. ARB staff analysis indicates the MVIP can reduce emissions of HC, CO, and NOx in the South Coast Air Basin by 67, 387, and 162 tons/day respectively when each vehicle is inspected annually. These reductions would constitute approximately a 20% reduction in HC, CO, and NOx emissions from the motor vehicle population. ITEM NO. 77-4-3 Technical, Nonsubstantive Amendments to Title 13. RECOMMENDATION Adopt Resolution 77-7. SUMMARY Chapter 957 of the Statutes of 1975 enacted a major recodification of California's air pollution control laws. However, to date there has been no concomitant revision of the various regulations of the Air Resources Board, contained in Title 13 of the California Administrative Code. Accordingly, many of these regulations still refer to sections of the law as they existed prior to the recodification. This leads to confusion and makes the regulations difficult to use. In order to rectify this situation, the statutory references and the citations of authority contained in these regulations have been updated and brought into conformity with the terms of the 1975 recodification. The changes indicated herein are exclusively nonsubstantive and technical in nature. A more comprehensive and substantive set of amendments to the ARB's regulations is planned to be submitted in the Spring. The staff therefore recommends that the revisions to the air pollution control regulations in Title 13 proposed here be adopted for purposes of clarity and consistency and to enable future, substantive amendments to be carried out in a more orderly manner. RECOMMENDATION Adopt Resolution 77-8. SUMMARY Chapter 957 of the Statutes of 1975 enacted a major recodification of California's air pollution control laws. Substantial additional changes were made by the recodification trailer bill, Chapter 1063 of the Statutes of 1976. This has resulted in a complete reorganization and renumbering of the Health and Safety Code sections relating to air pollution control. The nonvehicular regulations of the Air Resources Board, contained in Title 17 of the California Administrative Code, need to be amended to reflect this recodification. In addition, the Office of Administrative Hearings has requested that we provide citations to the underlying statutory authorities for each of our regulations. In order to remedy this situation the statutory references and citations of authority contained in these regulations have been updated and brought into conformity with the terms of the 1975 and 1976 recodification. The changes indicated herein are exclusively nonsubstantive and technical in nature. Additional substantive amendments to the ARB's regulations are scheduled for submission to the Board at its March 1977 meeting. The Legal Branch therefore recommends that the attached revisions to the air pollution control regulations in Title 17 be adopted for purposes of clarity and consistency and to enable future, substantive amendments to be carried out in a more orderly manner.
